NPA loses appeal on Cholota’s “illegal” extradition

The National Prosecuting Authority (NPA) has lost yet another legal battle with former Premier Ace Magashule’s former personal assistant Moroadi Cholota.
 
The Bloemfontein High Court on Friday dismissed the NPA’s application for leave to appeal a ruling on Cholota’s extradition.
 
Last week, Judge Phillip Loubser ruled that Cholota’s extradition from the United States of America last year was unlawful. He found that South African courts did not have jurisdiction to try Cholota on corruption that she and Magashule are charged with in the high-profile R255 million asbestos corruption scandal.
 
The NPA has been given 21 days to file the requisite petition to the Supreme Court of Appeal (SCA).
